If you want to read contents of medical records of the related legislations (Prohibition on leakage of secrets in Article 19 of the Medical Service Act, Reading records in Article 21 of the Medical Service Act, Article 13 of the Implementing Regulations in the Medical Service Act) or issue the copies, you can read them and issue the copies according to the specified laws and rules.

Informtion on preparatory documents

If a patient wants to read the contents of his/her medical records and issue the copies.

  • Identification card with his/her own photo

In case of relatives (The patient’s spouse, lineal ascendants, direct descendant, or the spouce’s lineal ascendants)

  • A copy of the identification card of the persons who request the issue the copies, the documents which can be proved to be the relative relationship including certificates of family relations and resident registration, the patient’s consent in his/her own handwriting (But, if the patient is the minor who is less than 14 years old, it is excluded. And if the applicant is not the legal representative, the legal representative’s consent needs to be attached.), and the patient’s copy of the identification (But, if the patient is less than 17 years old and the identification card is not issued in accordance with Clause 1, Article 24 of the Residents Registration Law, it is excluded.)

In case of the representatives who are designated by the patient,

  • A copy of the identification card of the persons who request the issue the copies, the patient’s consent and power of attorney in his/her own handwriting (If the patient is the minor who is less than 14 years old, the documents which can be proved to be the legal representative including certificates of family relations should be attached), and the patient’s copy of the identification (But, if the patient is less than 17 years old and the identification card is not issued in accordance with Clause 1, Article 24 of the Residents Registration Law, it is excluded.)

Preparatory documents when people ask the hospital to issue the copies of medical records if they cannot receive the patient’s consent

  • A copy of the identification card of the persons who request the issue the copies, the patient’s consent and power of attorney in his/her own handwriting (If the patient is the minor who is less than 14 years old, it should be written by the patient’s legal representative and the documents which can be proved to be the legal representative including certificates of family relations should be attached), and the patient’s copy of the identification (But, if the patient is less than 17 years old and the identification card is not issued in accordance with Clause 1, Article 24 of the Residents Registration Law, it is excluded.)

Preparatory documents when people ask the hospital to issue the copies of medical records if they cannot receive the patient’s consent

If the patient dies

  • A copy of the identification card of the persons who request the issue the copies
  • The documents which can be proved to be the relative relationship including certificates of family relations and resident registration
  • The documents which the patient’s death can be checked including certificates of family relations, residents registration, and family census register (Removed)

If the patient falls into unconsciousness or cannot autograph in his/her own handwriting due to seriouns diseases and injuries even though he/she does not fall into unconsciousness

  • A copy of the identification card of the persons who request the issue the copies
  • The documents which can be proved to be the relative relationship including certificates of family relations and resident registration
  • The medical certificate that the patient who falls into unconsciousness or cannot autograph in his/her own handwriting due to seriouns diseases and injuries can be checked

If the patient is is lost

  • A copy of the identification card of the persons who request the issue the copies
  • The documents which can be proved to be the relative relationship including certificates of family relations and resident registration
  • The document that the fact that the patient is lost can be checked including resident registrations and the court’s copy of determinations of declaration of disappearance

If the patient lacks mental capacity

  • A copy of the identification card of the persons who request the issue the copies
  • The documents which can be proved to be the relative relationship including certificates of family relations and resident registration
  • The court’s copy of determinations of interdiction and the psychiatrist’s medical certificate that the patient who lacks mental capacity is proved
